Legal Words:
- Liquidated damages: The damages agreed beforehand by the parties to a contract in case one of them should later break the terms of the contract.
- Abscond: when a person fails to present themselves before the court when required, such as when they have been released on bail and not returned to court.
- Affray: fighting unlawfully. It is a criminal offence
- Burglary : entering a building without permission with the intention of stealing or doing damage.
- Deposition: a statement, by a witness, made under oath.
Legal Maxims:
- Actori incumbit probation: The burden of proof is on the plaintiff.
- Actus non facit reum nisi mens sit rea: An act does not make a defendant guilty without a guilty mind. In other words, “The act itself does not constitute guilt unless done with a guilty intent.”
- Ubi jus ibi remedium: An action will lie for an injury although no actual damage be sustained.
- Pacta sund servanda: The parties to an agreement must do their best to fulfill their obligations under it.
- Pendente lite: During the suit; while litigation continues.
